"Assign to" defaults to first registered user when using "restrict_owner = true"

This is related to ticket #1296 which was fixed in  but seems to have re-emerged again. With restrict_owner set to true, the assign-to field is set to the first registered user which is rather inconvinient (The ticket submitter may not need to assign the ticket to anyone, merely enter it into the system)…
I suspect the re-factoring in may have broken this.
